- I/We confirm that by signing this declaration, I/We have read, understood, and agree to be bound by the terms and conditions of this declaration & loan application.
- I/We am/are aware that the processing fees paid by me/us for availing the loan/facility is non- refundable, including in the event of rejection or withdrawal of the loan application, and agree to levy of such non-refundability of processing fee.
- I/We understand and acknowledge that irrespective of acceptance or rejection of the loan application, any information provided by me/us shall continue to be stored and used, as may be required in accordance with Navkar Nivesh Private Limited (NNPL)’s internal policies/ procedures, as per applicable laws in India.
- I/We hereby confirm and declare that all the contents and information submitted by me/us whether in electronic or physical form are true and complete; and shall be the basis of any loan/facility that NNPL may decide to extend to me/us. I / We agree to indemnify NNPL for any losses or damages that may arise on account of any misstatement, misrepresentation or negligence by me/us with respect to the aforesaid information. I/We confirm that all the contact details, including mobile number and email ID furnished with this application form are true and correct, and belong to me/us.
- I/We hereby confirm and undertake that in case of any change in contact details including mobile number and e-mail ID, as has been provided under the loan application form, I/we will promptly notify NNPL of any change of such contact details. I/We hereby confirm that non-provision / non-updating of the contact details would amount to me/us not receiving SMS / e-mail alerts pertaining to the loan / facility and declare that I/We shall not, and, shall not hold NNPL liable or accountable for the same.
- I/we declare and hereby confirm that no other financial assistance has been availed from any other bank or financial institution, except as expressly stated in the information provided by me/us.
- I/We confirm that I/we am/are aware and informed that for the purpose of provisioning of the services in relation to the loan/facilities, NNPL is required to share information with third parties. I/we confirm and authorise NNPL to share such information with third parties and verify the information provided, either by itself or by using the services of third parties and expressly authorise such third parties as well as NNPL to verify any information provided including but not limited to course enrolment, present & permanent residence, employment, EPFO, telephone, mobile verification, email, bank account, PAN, Identity Document, CIBIL or any other bureau (CRIF, Experian, Equifax) credit repayment history checks, financial documents such as ITR/Form 16, 26AS, verification, references check, etc., in accordance with the applicable laws in India.
- I/We agree and give consent for the disclosure by NNPL of all or any such; (a) information and data relating to me/us (b) information or data relating to any credit facility availed of/to be availed of by me/us and (c) information or data relating to defaults, if any, committed by me/us in discharge of my/our such obligation, as NNPL may deem appropriate and necessary, to Credit Information Companies (CICs) and any other statutory authority authorised in this behalf by Reserve Bank of India (RBI).
- I/we hereby confirm and declare that in compliance with the provisions of Prevention of Money Laundering (Maintenance of Records) Rules 2005 and applicable RBI regulation, I/we shall intimate NNPL if there is any change in my/our KYC details, and such intimation shall be accompanied with the updated documents (e.g. address proof, contact details, renewal of passport, etc.) within a period of thirty (30) days from the date on which the receipt of change was received by me/us.
- I/We hereby declare and affirm that the property presented as security for this transaction is wholly and exclusively owned by me/us, free from any third-party claims, encumbrances, or disputes. There are no legal proceedings, attachments, or liens of any nature currently initiated or pending against said property. The property offered as security, as detailed in the loan application, is marketable and clear of any and all encumbrances, liabilities, or legal deficiencies. I/We possess full legal title and authority to offer said property as collateral for availing this loan/facility.
- I/we understand and acknowledge that NNPL would not be able to process the loan application until all information as per NNPL’s credit and underwriting norms is provided by me/us and until all the requisite verifications and check are completed. I/We further declare that I/We shall cooperate fully with NNPL, its officers, and its agents for the purposes of completing such credit/underwriting process, and for the purposes of the aforementioned verifications and checks in connection with this loan application.
- I/We understand that NNPL retains its absolute discretion to reject my/our application, and NNPL shall not be responsible or liable in any manner whatsoever to me/us or any third-party for any rejection, or for any delay in notifying such rejection, including for any costs, losses, damages, or any expenses or consequences caused by such rejection of my/our application.
- I/ We understand that various factors bear an impact on the risk profile of the customer/ applicant. The rate of interest may therefore vary from customer/ applicant to customer/ applicant depending upon the profile of the customer/ applicant.
- I/ We acknowledge that it is my/our responsibility t to obtain registration under CGST Act 2017, SGST Act 2017, IGST Act 2017, and UTGST Act 2017 (hereinafter individually/collectively referred to as “GST Law”), in case applicable to me/ us and disclose to NNPL the relevant registration number/s. Additionally, I/we hereby declare that in case of any violation of any taxation laws by me/us, I/we shall indemnify NNPL for any loss or claim or demand or penalty, if any, which may be incurred or suffered by NNPL.
- I/We hereby confirm that my/our current address may be considered for the purpose of computation of GST if I/ We am/are not registered under GST Act. I/We declare that my/our current address registered under GST would be considered for the purpose of computation of GST if I/ We am/are registered under GST Act. I/We hereby declare to immediately intimate NNPL upon any change in my/our address and contact details for communication.
- I/ We acknowledge that if the applicant is a minor or resides outside India and the co-applicant is the resident Indian, the address of the co-applicant’s address will be considered as address on record for the purpose of determining place of supply under GST.
- I/We give my/our consent to receive any promotional material / scheme of NNPL and its associates, partners & affiliates via email, sms, whatsapp, or in physical form
- I/We hereby give consent to NNPL to download / update/register KYC details from the Central KYC Registry and to receive the information from the CKYC Registry via on registered contact number /email. Further I/We hereby confirm and understand that the KYC details obtained by NNPL from the Central KYC Registry will be used only for the purposes of conducting KYC in accordance with applicable RBI regulations.
- I/We hereby consent to share the required personal and loan information/data with life insurance companies, travel insurance companies & health insurance companies to acquire the insurance policy/ies as applied by us/me.
- I/We understand that masked Aadhar or any identity details (identity and address proofs) provided by me/us is solely for the purpose of availing the loan/facility. NNPL shall not use such details for any purpose other than as specified above.
- I/ We acknowledge that NNPL’s policies do not permit acceptance of cash for any of the loan transactions. NNPL prefers all the loan related payments to be made from the applicant or co- applicant’s bank account through any banking means such as Cheque/DD/NEFT/RTGS/IMPs. I/ We understand that I/ We shall be solely responsible for cash transactions, if any, carried out with NNPL’s representatives or associates or any other third party.
- I/We understand that issuance of the sanction letter shall be at the sole discretion of NNPL and shall be subject to its internal policy.
- I/We further understand and acknowledge that NNPL may procure any other information or carry out verification that NNPL may have access to or that is otherwise available in the public domain and conduct such diligence / investigation, as NNPL may deem fit, for the purpose of the loan/facility.
- I/We acknowledge that any request given for cancellation of loan post disbursement, shall be treated as a request for loan foreclosure.
- I/We confirm that no insolvency proceedings or suits for recovery of outstanding dues or monies whatsoever and/or any criminal proceedings have been initiated and/or are pending against me/us and that I/We have never been adjudicated insolvent by any court or other authority.
- No action nor other steps have been taken or legal proceedings started by or against me/us in any court of law/other authorities for winding up, dissolution, administration or reorganization or for the appointment of a receiver, administrator, administrative receiver, trustee or similar officer or for my/our assets or properties.
- I declare that I have willingly submitted my Aadhar card copy as KYC for the purpose of availing a loan from NNPL.
Note: The processing fees and charges paid for the loan application are non-refundable, regardless of whether the loan application is approved, rejected, or withdrawn.
